Instructions on employees' Selection and appointment in Civil Service

Instructions on employees' selection and appointment in the public jobs of the first, second and third categories issued by Civil Service Council

 

 

 

 According to provisions of clause a, article 42 of the Civil Service system No. 30 for 2007

 

 

 

Article: 42

 

a-     Appointment on jobs, of specific functional feature, shall be based upon the valid instructions on jobs' description and classification, in condition that there are vacancies in the jobs formation table and in compliance with the instructions of employees' selection and appointment issued by the Council, upon the Bureau's decision, the services of the assigned employees are subject to the rules of the social security law.

 

 


 

Article (1)

-         These instructions called (Employees' selection and appointment instructions in civil service jobs of the first, second and third categories for the years 2007-2010 and start to be in force from its confirmation date.

 

Article (2)

-         These instructions are considered the foundation to issue the competitive lists to the job applicants for the public jobs.

 

 

First chapter

General principles

 

Article (3)

a-     The application shall be presented to the Civil Service upon these instructions on the form which the Bureau had prepared for this purpose as the following:

1-    To the Bureau to fill the vacancy of first and second categories jobs.

2-    To the concerned department to occupy jobs with comprehensive contracts.

3-    To the concerned department and/or the national employment center to occupy in the third group jobs.

 

b-     The competition lists of the applicants are classified upon the academic qualifications as the following:

1-      Diploma certificate of community faculties for appointment in second group jobs.

2-      Bachelor certificate, high diploma and masters as one requirement for jobs of the first group according to the main major in the bachelor certificate.

3-      Masters certificate for selection in jobs whose occupation stipulates this qualification in particular.

4-      PHD certificate.

5-      Major certificates in medicine upon rules of the working law of the Jordanian Medicine Council.

 

c-      Considering what is provided in clause a of this article, the applicant shall not present the application except for one job group, while if the applicant holds two degrees of the same level in two different majors then he may apply two job applications for theses majors within the same group.

 

Article (4)

 

a-      The personal card issued from the Civil Status and Passports Department is the used document to determine the residence address of the applicant.

 

b-      The applicant shall provide the Bureau with the documents that prove the address change during three months of the movement date, otherwise rules of clause c of this article shall be applied.

 

c-       In spite of the provided in clause a of this article, the Bureau may investigate the correctness of the offered data in the manner it considers suitable, and if found that the applicant does not live in the geographic area that he/she has fixed in the application, his request will be rejected and his/her name won't be listed in the competition reports only after presenting new application in the following year, and the application's seniority is calculated from the date of presenting the new application.

 

d-      In the case that the job applicant was nominated or appointed and found later that he/ she does not have actual and continuous residence in the geographic area upon which was appointed before the appointment not less than one year, his appointment or selection shall be cancelled, the application also is invalid and the rules of clause c of this article shall be applied.

 

e-       Considering what is provided in clause a of this article, the document relied to determine applicants' names who reside in the Al- Badia  areas is the document issued from clans' affairs services.

 

Article (5)

 

-         It is necessary to comply with clause b of article 4 and also these bases shall be considered:

 

a-          Changing residence address will not be considered after issuing the competition lists, and the applicant name shall be deleted from the current address and added to lists appendices related to the area to which he moved and the Bureau issues.

 

b-         If the applicant presented any new academic qualifications, the applicant shall continue to compete in the current qualification, his/ her name shall be added to the lists appendices related to the area he applied upon and refer to them when the required majors are not available in the main competition list of the same area.

 

 

 

 

Article (6)

 

-         Considering rules provided in article 43 of the valid Civil Service Statute, it is provided in the applicant to the Civil Service bureau not to be of the resigned nor of the responsible for the resigned jobs in the governmental establishments, except the part time employees who were appointed out of the employees' selection instructions, and the employees appointed in third group jobs who obtained diploma of society faculty or a higher degree.

 

Article (7)

 

- While selection for jobs that demand special requirement to fill it is possible to consider the academic qualification, the unique experiences and/or training sources and/or the special skills related to the vacant job in condition that it should be concordant to the job description of the vacancy, also shall be verified and presented to the Bureau with the application, in event of no nominees were available in the Bureau upon the required conditions then the department may refer to announcement as mentioned in article 29 of these instructions.     

      

Article (8)

 

a-     The Bureau shall issue main competition record to be used for selection once a year, applications received after the record issuance will be listed in additional appendices to be referred to only in case of unavailability of the required majors in the main competition list of the same area before referring to endorsement, such application will not be listed in the main list only in the following year.

 

b-    The competition lists of the applicants are prepared upon the scientific qualification, the major, the gender and the geographic area as well as any data or conditions which the job nature demands.

 

Article (9)

 

a-     The department shall notify the Bureau of the vacant jobs in the first, second and third categories and inclusive contracts jobs, jobs on the projects account, and on the employees' salaries account who are stopped work and were assigned by contracts on project account, transferred substitute or substitute for employee in leave for selection purposes according to a certain form prepared by the Bureau in a time does not exceed one month from the issuance of the public jobs formation table, the priority of occupying the vacancies is for the departments that stick to the specific date.

 

b-    Priority of selection is for permanent vacancies listed in the formations table in any department whose employees were assigned upon contracts on projects account, salaries account of employees who stopped work for secondment or vacation without salary nor allowances according to effective instruction of employees' selection working then, stipulate that the department shall consider this priority whole preparing jobs formations table including the job title, the qualifications and necessary majors to occupy such jobs and not exceed the allocated funds for this job, in event there were some employees of these categories more than the employees number of the permanent vacant jobs the following standards shall be taken upon the priority to select the employees who most deserves the selection in the following order:

 

1-    Seniority of appointment in the department.

2-    The stated credit in the annual report of the employee in the last year.

3-    The scientific qualification of the employee.

4-    The highest average of the scientific qualification which the employee has.

 

 

c-     If contracts of employees previously assigned upon employees' selection instructions working then because of the project end, its allocations' consumption or the return of the transferred employee or from the vacation to their jobs, these persons will have the priority to selection in the vacancies of that department or another department corresponding to their qualifications and majors upon the standards stated in clause b of this article and these instructions won't be applied upon them.

 

d-    Rules of clauses b & c of this article do not apply on the employees with contracts who were appointed out of the instructions of employees' selection in the public jobs and whose services shall be finished once the project is ended or its allocations are consumed.

 

 

 

 

 

Article (10)

-         The concerned department that has vacant jobs with inclusive contracts of all allowances shall set detailed descriptions of these jobs and shall inform the Bureau with their titles and its detailed job description, the qualifications, experiences, capacities, and required skill for occupation, as well as the jobs number and their corresponding wages, coordinate with the Bureau to execute the selection procedures of these posts according to the rules and conditions stated in clause a of article 60 of the effective Civil Service System.


 

Second chapter

Employees' selection and appointment

for the first and second  jobs categories

 

Article (11)

 

-         Preparing the competition lists of the appointment applicants of university degrees holders and society faculties certificates holders for competition tests and selection nominations is executed upon a competition standard with limit of 40 points calculated as the following:

 

a-     qualification: measured by the rate or the general average of the scientific certificates with 20 points divided in the following manner:

 

1-    the scientific qualification higher than the general secondary school and has 12 points divided as the following;

·        If the rate and the average were available in the scientific qualification the rate stated in the university certificate will be adopted.

·        If rates other than the ones stated in the above table the average will be adopted.

·        If neither rate nor average of the university certificate (second or third) were available then the rate or the average of the first university certificate will be used.

·        With respect to the major certificate in medicine the first university average shall be adopted and the master certificate holder shall be granted two extra points while the PHD certificate give its holder 4 extra points.

 

2-    The total result of the exam for the university graduates other than the Jordanian universities as general doctors, dentists or pharmacist is adopted instead of the points allocated for the university certificate as the following:

3-    Concerning the Jordanian universities graduates who are specialized in majors mentioned in clause 2 of this provision, the rate of the certificate issued from the university is to be adopted.

4-    The rate of the secondary study or its equivalent has 8 points divided as the following:

b-    Antecedence: given 20 points divided as the following:

1.     Graduation precedence: measured by the years' number passed since the date of applicant obtaining the approved scientific qualification for competition, it is granted 10 points calculated as the following manner:

·        At the beginning of every year the antecedence points table are advanced one year forward so to make the tables deign in the year that form the start year for the next ten years.

 

c-     In addition to the points merit to the applicant upon clauses( a & b) of this article, and for purposes of the competition list release according to provision 2 of clause a of article 3m in these instructions, the master or high diploma certificate holder after the first university certificate in the same major shall be granted 4 points and 2 points respectively. Master and high diploma certificates in education major and its specializations are considered as certificate corresponding to the same major of Bachelor certificate for competition purposes on the selection for educational careers, masters and high diploma certificates holders, in another major in the first university certificate, shall be given two points and one point respectively and it is not allowed to merge the granted points for these qualifications. 

 

 

 

d-    In case of equality in the points' total the following preference standards shall be applied according to their priority in the following order:

 

1.     Year of presenting the application.

2.     Precedence of graduation year.

3.     Average of the scientific qualification.

4.     Average of the secondary school certificate.

 

e-     1. Selection to fill the vacancies is restricted to occupy teacher vacancy in the Ministry of Education for those who have the highest score upon the principles and of persons who did not exceed age of 45 years until the date 31/12 of the previous year for the selection operation.

 

2.     In event of no candidates with the requirements stated in provision 1 of this clause were available, then selection will take place based on the same geographic area of whose ages exceed 45 years upon the highest scores according to these principles.

 

f-      Graduates delegated by the Ministry of Education to scientific scholarship to obtain Bachelor degree upon special legislations of the ministry are excluded of these instructions and will be assigned at the Ministry.


 

Article (12)

 

a-     competition between applicants to public jobs occurs between residents of the same area considering that it forms an administrative unit, nomination will take place basing on the district of the Education Ministry, in case of not having the required major available in the district selection will extend to the province level, if major is not available in province level the competition will be on the region level, if still not available competition shall include the Kingdom citizens considering it as one unit and use the highest score as a base for selection.

b-    Competition for the rest of the ministries shall be on the province level and selection will depend on this base, if the majors are not available on this level, competition will extend to region level and then to the Kingdom level for the fact that it is one unit and if the required major is not found on the region level it will depend on the highest score.

c-     The Kingdom is divided for the stated purposes in clauses a & b of this article as the following:

·        The northern region: includes the provinces Irbed, Jerash, Ajloun, Mafraq and the northern Badya.

·        The meddle region: includes the provinces the capital, Balqa, Zarqa, Ma'daba and the middle Badya.

·        The southern region: includes the provinces Karak, Tafilah, Ma'an, Aqaba and the southern Badya. 

 

d-    1- Northern, middle and southern Badya are trated as (district) in selection for the Ministry of Education and as (province) for selection at the other departments.

 

2- If selection from the three regions of Badya failed for unavailability of the required majors then priority for nomination will be of the province/ district citizens in following administrative units.

 

e-     while occupying jobs in ministries, departments public official establishments and the bodies with no branches in the provinces it is possible to select candidates on the level of the province, region or the Kingdom upon the highest scores.

 


 

Article (13)

 

a-     For the purpose of filling the vacancies in the ministries, government establishments and departments except the education posts in the Education Ministry and health posts in Health Ministry, the Bureau shall nominate 6 candidates or the available number if it was less for each vacant job depending on the competition lists prepared according to provisions of article 11 of these instructions preparing for testing them by the competition exam that shall be executed and supervised by the Bureau directly.

b-    The Bureau shall coordinate with the concerned department/s so as to ask the candidates to attend the exam by making an announcement in one local newspaper at least.

c-     The Bureau shall organize the competition exams process and authorize the specialized experts to set the questions of the required exam and correct them upon the department's needs, the exam will be out of 40, and the applicant succeeds if obtained 20 marks. The concerned department/s is charged with this exam costs and its procedures.

d-    The Bureau announces the names of the successful in the competition exam by the means it considers fit. Names order is based on the priority of nomination for selection according to the accumulated points that amount 80 points which refers to the total of the competition points stated in article 11 of these instructions and the mark of the competition exam.

e-     The Bureau shall nominate the persons who obtained the highest points in the amount of three candidates for one vacant job or the available number if the number of the successful people was less than 3 in order to submit them to the personal interview.

f-      The department shall invite the candidates nominated for the interview by announcement in one daily local newspaper at least to be in a date does not exceed one week since receiving the interview candidates lists, provided that all procedures related to the selection shall be ended within two weeks since the receipt date otherwise the Bureau shall recall the nomination lists and give priority to other departments.

g-     The Bureau shall prepare a special form for the personal interviews to measure specific standards to fill the vacant job and 20 marks are allocated to the personal interview.

h-    Employees affairs committee formed upon provisions of article 39 of the effective Civil Service System shall execute the personal interviews, fill the interviews' forms and prepare the final report in the same day on which the interviews took place, it also may seek assistance from the experts of this field including forming one subcommittee or more for that purpose.

i-       In spite of the provided in clause (h) of this article, the interviews committees have the right to reject or decide inefficiency of the applicant to occupy the job stipulate that the decision shall be justified to the Bureau and in such case the result of the interview will be a zero.

j-       In case equal results between the candidates in the merit marks stated in clause (d) of this article and the interview points the preference standards will be used according to the priority upon following order:

1-    Result of the personal interview.

2-    Average in the scientific qualification.

3-    Average of the secondary school certificate.

 

k-    the department shall submit the final results for the employees selection operation for the appointment to the Bureau attached with the necessary support documents of those who were selected to proceed the appointment procedures upon the provisions of the Civil Service System.

 

Article (14)

-         In spite of the stated in article 13 of these instructions, the Bureau may execute general competition tests for applicants for similar support administrative, financial and technical posts to in the departments and execute the interviews for the candidates who had passed through a special committee formed by the Bureau' Head and he may seek help from experts inside and outside the government for this purpose, appointment candidates will be selected upon the points' total in the competition lists, the exam and the personal interviews, the selected name shall be organized in a list so as to continue the appointment procedures in any department in the amount of one person for each vacant job.

 

 

 

 

 

 

Article (15)

 

a-     Considering the stated in article 13 of these instructions, appointment nomination for educational vacant posts in the Ministry of Education and health jobs in the Ministry of Health upon the competition order explained in article 11 of these instructions in amount of one candidate for each vacant job and in case of equal points of candidates the preference standards stated in clause (d) of the instructions will be used.

b-    Ministries of Health and Education shall invite the candidates through one daily newspaper at least and in a date that does not exceed two weeks since the date of receiving the candidates' lists from the Bureau in order to make the interviews by committees formed by the Minister to decide the fitness of the candidates to be assigned in these two ministries.

c-     The concerned ministry shall submit the interviews' results which the committees have executed upon clause (b) of this article including reasons of rejection of the candidate not selected to the Civil Service Bureau in order to nominate substitutes.

d-    The candidate who was not chosen for the selection may appeal to the committee formed upon clause (e) of this article within ten days from the rejection date fixed on the declarations poster.

e-     In both Ministry of Education and Ministry of Health a specific committee shall be founded directed by the Secretary-general of the Ministry and two members of the concerned ministry and two members of the Bureau to study the objection of the candidates who were rejected in selection upon clause ( c) of this article, and meet them to make the correct decision and its ward in this case will be final and these rejected persons may not be nominated to the same ministry.

 

 

 

 

 

 

 

 

 

 

 

 

 

Article (16)

 

a-     Every appointment applicant who was absent in the competition tests, in the personal interview or the selection procedures will be considered rejected.

b-    In spite of the stated in clause (a) of this article the head of the Bureau may agree on postponing the applicant nomination and keep him within the competition list for a period that does not exceed one year according to a written request presented by the concerned person.

c-     Upon clause (a) of this article the rejected person's name will be deleted from the competition list, his application will be cancelled and his name won't be merged into the competition lists only after presenting a new appointment application in the next year for his abstention, the precedence of his application will be calculated starting from the date of the new application.

d-    If the absent was one of the employees who has a subscription in the General Establishment for Social Insurance and earns a salary equal or more than his counterpart in the Civil Service then his application shall be cancelled and cannot apply again to the Civil Service unless present a document verifying subscription termination in the Social Insurance and dealing with the new application well be subject to clause (c ) of this article.

e-     In certain and justified cases, it is possible to exclude the absent person from the provisions of clauses (a & c) of this article and keep his nomination standing or give him another chance for nomination by a decision from the Bureau's head upon the selection of a committee he forms for this purpose.

f-      If the candidate failed in the competition test he may be nominated for similar competition test upon his order in the original one in the Civil Service Bureau with a limit that does not exceed the same scientific qualification, afterward his application will be cancelled and cannot apply again only if he obtained a new scientific qualification.


 

Third chapter

Third group employees' selection and appointment

Article (17)

a-     the department shall announce for the vacant job in the third group jobs in one daily local newspaper at least specifying the main occupation conditions as qualifications, experiences, training and the job title besides any additional conditions demanded by the work interest as the address, age, gender, last date for applying and others.

b-    People who fulfill the condition of occupying the vacancy published in one local newspaper at least shall be asked to make the test and/or the personal interviews upon the need.

 

Article (18)

a-     Appointment applications for the announced jobs shall be presented to the concerned department according to the application form prepared by the Civil Service Bureau for this purpose.

b-    The department may ask the National Employment Center to provide it with candidates to fill the third group vacancies.

c-     Any application submitted after the end of the specific date fixed in the job vacancy announcement will not be considered.

 

Article (19)

-         competition on candidates selection for the third group jobs is done according to a competition standards with maximum limit of 100 points upon the following standards:

a-     The academic level: given 20 points divided as the following:

-         3 points for who had finished the elementary stage or what equalize it (provided that knowing how to write and read is obligatory)

-         5 points for those who finished the secondary school.

-         7 points for secondary school certificate holder in any branch or what equalize it.

-         10 points for society faculty diploma holder (one year after secondary school).

-         Applicant who has professional or crafts training certificate shall be granted the merit points upon the determined training period for the educational level as well as what he deserves of points, stipulate that the maximum limit shall not exceed 20 points upon this clause for the educational level as the following:

·        4 points for those who hold the secondary certificate suitable to the nature of the vacant job.

·        4 points for profession or craft training for 6 months.

·        8 points for profession or craft training for one year.

·        12 points for profession or craft training for two years.

 

b-    The training courses: the candidate will be granted 2 points for each training program not less than two weeks from an approved training center or institute provided that this training shall be related to the vacant job nature, with a limit amounts 10 points and it is possible to gather the merit points of training in this clause and the points of profession training points stated in clause (a) of this article.

c-     Practical experiences: they are measured by the numbers of the experience years which the applicant earns and corresponding to the vacant job nature, the candidate is granted 4 points for each year of experience up to a limit 20 points.

d-    Competition tests and/or interviews: given 50 points divided as the following:

1-    The competition exam (30) points.

2-    The personal interview (20) points

3-    When one of the above is adopted (the exam or the interview) each will be calculated out of 50.

 

Article (20)

 

a-     for each vacancy 6 persons will be nominated or the available number if it was less than 6 of the applicants to one vacant job who fulfill the required conditions so as to execute the exams upon the highest points they earned according to clauses (a, b, c) in article 19 of these instructions.

b-    Nomination will be for 3 persons or for the available number if it was less than 3 for the vacant job of the successful and according to the highest merit marks in the competition exam so as to submit them to the personal interview.

c-     If the personal interview was sufficient without making competition exams for the applicants, four persons or the available number if it was less than 4 will be nominated for one vacancy to make the interviews upon the merit points as clarified in clause a of this article to select the most qualified among them.

 

 

 

 

 

Article (21)

 

-                                       competition between applicants for third group jobs occurs on district level, the northern, middle and southern Badiah are geographic areas treated as a district for this purpose, in vase of not meeting the required specifications in the district competition will extend to the province level then to the region level through a new announcement.

 

Article (22)

 

-                                       The Employees affairs committee and the subcommittees formed upon provisions of article 39 in the Civil Service System undertake supervision on procedures of executing the competition exams and/or the personal interviews, determining the candidates who deserve selection by calculating the merit points for each candidate as in clauses (a, b, c, d) of article 19 according to the forms of the interview and the final selection prepared by the Bureau for this aim. The committee will submit its selection and the choices of the subcommittees to the concerned minister to make the right decision regarding this process.

 

Article (23)

 

-         If the candidate were equal in the points the priority of selection will be given for the higher level educationally, then to the higher experience level and then to the married person.

 

Article (24)

 

a-     The department shall display the results of the competition exams and/or the personal interview as well as the final results for the candidates on the declaration poster in the department during one week since executing the final selection and inviting the selected persons to complete the selection procedures by an announcement in one daily newspaper at least.

 

b-     If the nominated person for the test, the interview or if the invited candidate to finish the procedures did not appear during the determined period or if a decision was issued to appoint him during 10 days from the determined period in the announcement then he will be absent from selection and the person after him in the points total will be selected.

 

Article (25)

 

-         Provisions concerning humanitarian cases stated in article 28 0f these instructions shall be applied on the persons who presented job applications on humanitarian cases in the third group jobs.

 

Article (26)

 

-         Each department shall furnish the Civil Service Bureau and the Accounting Office with copies of nomination and selection forms verified from the concerned committees, the selection decisions from the secretary-general or the general manager of the department within two weeks from the date of issuing the appointment decision.

 

Article (27)

 

- It is not allowed to appoint on jobs of this group whatsoever only upon these instructions, and any decision issued without complying with these instructions will be faulty one and requires cancel.

 


 

Forth chapter

Appointment on humanitarian cases

 

Article (28)

 

a-      Humanitarian cases for purposes to apply these instructions are determined as the following:

 

1.     Member of a poor family whose supplier earns regular aid from the National Aid Fund upon an effective card.

2.     the disabled according to the legal definition whose disability does not affect their performance of the jobs to which the will be nominated upon a medical report issued from the Medical Committee in the province of his residence

3.     Member of a family who has four qualified members that had presented application to the Bureau with society faculty diploma (inclusive) upon the following conditions:

-         Submit a document issued by the General Establishment for Social Insurance certifying that the applicant has no subscription in the social insurance.

-         All the applicants shall be registered in one effective family book.

-         Application of this group can be renewed upon new documents in each year before issuing the competition lists.

 

4.     Urgent and special cases transferred from the Bureau to the formed committee as in clause g of this article after being approved by this committee.

 

b-      Except the disability cases no family may take advantage of the humanitarian cases stated in this article more than once, it is not allowed also to accept any application from the family member on any of these cases again, the Bureau has the right to cancel nomination or selection of any beneficiary from these cases if incorrectness or inaccuracy was found in the information presented to the Bureau.

 

c-       6% of the vacancies' total in the government departments is allocated for the humanitarian cases stated in this article.

 

 

 

 

 

d-      Competition among applicants for vacancies on humanitarian cases depends on the date of presenting the application and nomination to fill the rates that can be allocated for the humanitarian cases in the districts, provinces and on the Kingdom level upon the number of vacancies, allocations and the departments' needs in coordination with the Bureau and the concerned departments.

 

e-       Persons chosen from humanitarian cases group will be nominated to the departments within the determined rates upon the available vacancies in each department corresponding to the required majors for the competition tests for cases stated in provisions 3 , 1 of clause a of this article, selection for categories mentioned in the provisions 4, 2, the departments shall provide the Civil Service Bureau with the related documents so as to complete the appointment procedures.

 

f-        If candidates have equal points obtained upon the date of presenting the application, the following preference standards will be used:

 

 

1-    Antecedence of graduation year.

 

2-    Average of the scientific qualification.

 

 

g-      A committee shall be formed by the Civil Service Bureau, Ministry of Health and the National Aid Fund to make a decision concerning the adoption of the disability group, national aid group and urgent and special cases transferred from the Bureau head to this committee whose other tasks and manner of action shall be determined upon instructions issued by the Head of the Bureau.


 

Fifth chapter

General conditions

 

Article (29)

 

-         If the job specifications to occupy a job are not available in the competition lists at the Bureau, the vacant job shall be announced in one daily local newspaper in coordination between the Bureau and the concerned departments, selection procedures shall be executed upon these instructions.

 

Article (30)

 

-         The following are excluded from theses instructions:

 

a-     Appointments on vacant jobs in the Royal Bureau.

 

b-    Sons and daughters of martyrs of the Armed forces, Public Security, Civil Defense and General Secret Police and their alike and not considered part of the percentage specified for humanitarian cases, and they have priority of selection. 

 

Article (31)

 

-         It is not allowed to accept an selection or make any change in the data of it unless by the applicant directly.

 

Article (32)

 

-                     The Head of the Bureau has the power of canceling any procedure regarding the nomination or the selection if it was found that this procedure was issued using information, data or documents that contradict the instructions of selecting and assigning the employees.

 

Article (33)

 

-  the Bureau' head shall refer the recommendations concerning any case not handled in these instructions to the Civil Service Council to issue the decision it considers suitable in this concern.
